Registration of chemical products

The Law "On the Safety of chemical products" No. 302-III of July 21, 2007 is in force in the Republic of Kazakhstan

Chemical products that are not registered in accordance with the requirements of the above Law are not allowed for circulation

 

The applicant (manufacturer, supplier, importer) supplying chemical products to the market is obliged to accompany it with a Safety Data Sheet.

 

The chemical Product Safety Data sheet is a document that is a mandatory document for chemical products, the main purpose of which is to provide the consumer with information on the safety of industrial use, storage, transportation and disposal (liquidation) of chemical products, as well as its use for domestic and industrial purposes.

 

Each company develops an individual safety data sheet of the substance, because products with the same name, but from different manufacturers, can vary significantly in properties.

 

MANDATORY REQUIREMENT: The safety data sheet of chemical products is issued and registered before the goods are delivered to the market.

EAEU Technical Regulations 041/2017

 

The decision of the Council of the Eurasian Economic Commission No. 19 of March 03, 2017 was approved EAEU Technical Regulation 041/2017 "On the Safety of chemical products". Currently, the effect of this TR has not entered into force.

 

The EAEU TR 041/2017 establishes uniform requirements for chemical products in the EAEU countries. rules and forms of conformity assessment, identification, requirements for labeling and its application to chemical products.

 

The requirements of the EAEU TR 041/2017 affect a wide range of manufacturers, importers and users not only in the chemical industry, but also in the oil and gas, agrochemical, oil refining, pharmaceutical, cosmetic, tobacco, furniture, woodworking, construction industry and other industrial sectors.

 

According to the EAEU TR 041/2017, the absence of information about a chemical in the EAEU Register of Chemicals and Mixtures (hereinafter referred to as the Register), after the entry into force of the Technical Regulations, defines this substance as new and imposes additional obligations on the manufacturer/importer.

 

In particular, for the admission of chemical products to the EAEU market, all new chemicals, including those in mixtures, must first undergo a notification procedure, which implies a comprehensive study of the hazardous properties of the substance and filling out a chemical safety report (According to the Ministry of Industry and Trade of the Russian Federation, the cost of research within the notification of only one substance involves the conclusion of a contract it costs up to 250 thousand euros and will take an average of 2 years. At the same time, according to the wording of the draft Procedure for notification of new chemicals, the specified period will reach up to 3 years).

 

In order to avoid excessive regulation of chemicals and reduce the excessive burden on producers/importers, business entities need to prepare for the inventory procedure and the subsequent stage of the formation of the national part of the Register.

 

In accordance with the Technical Regulations, chemicals, including those from the composition of chemical mixtures that filled out inventory registers included in the national part of the Register, will be exempt from notification, i.e. from an expensive procedure.
